Conveyancing

Conveyancing is a specialist area of law that specifically relates to the legal side of moving house.  In essence, it is the legal transfer of property from one person to another.

Conveyancers are lawyers that specialise in the legal process of buying, selling or changing ownership of property. 

As soon as you have accepted an offer, you will need to formally instruct a firm to begin the conveyancing process.

The estate agent will send the Memorandum of Sale to the Conveyancing firm which will provide all of the details needed including the agreed sale price, the buyers details and their conveyancer’s details.

The next steps involves completing a number of detailed questionnaires about the property and what you intend to include in the same.  These will be provided to the buyers conveyancers, along with the sale contract, for review.  There will then be a period of enquiries and negotiations before agreeing to move forward to exchange contracts.

The seller and the buyer conveyancers will agree a date and time to exchange contracts.  Once exchange of contracts has taken place, this forms a legally binding agreement to sell the property.  This will include an agreed date or timescale for completing the house sale.

The completion date is the day that the outstanding balance is paid by the buyers conveyancers, you move out of the property and the keys are handed over to the buyer.

The timescales for this will vary depending on whether there is a related purchase, if there are multiple people in the chain or if there are complications during the enquiries stage.  On average, a conveyancing process can take around 12-16 weeks.
